North Carolina Swimming Pool Accidents

Swimming Pool Accidents in Charlotte, North Carolina

As the North Carolina summer and the sweltering heat approach, many will inevitably take a trip or a few to the pool this season for a nice retreat. What happens when a swimming pool is not properly maintained, or when safety measures aren’t implemented to keep young kids away from what has been considered an attractive nuisance? All of these and many other questions can be answered by scheduling a FREE Consultation with our Personal Injury lawyers at Biazzo & Panchenko Law, who serve Charlotte, Matthews, and surrounding areas.

What Happens if I get Hurt at a Public Pool?

Drownings are typically infrequent at public pools due to the fact that they usually have fences around them and lifeguards on duty during open hours. You or your kids are far more likely to get injured at a public pool from uneven pavement, pool flooring in disrepair or some other defect caused by improper pool maintenance. Swimming pool injuries include but are not limited to slip and fall injuries, such as slipping on a wet surface or a diving board, burns and lung irritation from excessive pool chemicals, electrocution, exposure to harmful bacteria and chemicals and drowning. Most often these types of swimming pool accidents are caused by one or a few different negligent actions or inactions including but not limited to: a lack of safety equipment, defective diving boards, inadequate pool maintenance or lighting, damaged pool ladders, lack of lifeguards, improper drains, improper pool design and construction, a lack of barriers in the pool area, and defective pool parts. Claims pursued for public pool accidents and other premises liability claims are typically commenced with the insurance policy that is maintained by the entity that owns and operates the public pool.

What Happens if I get Hurt at a Private Pool?

One of the most common types of private pool accidents occur when small children, who are unable to swim, find their way into a private pool with no lifeguards or responsible supervisory adults present. Private pool owners are generally expected to maintain a fence around their pools to keep out lawful entrants on their property or trespassers who have not been invited to go into their pools. Private pool owners are also generally expected to maintain safe pool and flooring conditions or warn their guests of any hazardous defects or conditions in or around their pool. When someone is injured at a private pool, they typically initiate a claim against the pool owner’s homeowner’s insurance policy.

What if I Helped Cause my Injury?

North Carolina is a contributory negligence state, meaning that if you are found to be either fully or partially responsible for causing your own injuries, you are completely barred from recovering damages from any other party who may have contributed to your injuries, regardless of your degree of fault. So if you are injured from engaging in horseplay, dangerous activities, or you failed to observe an open and obvious hazard or one that you were warned of, you will likely recover nothing for your injuries at the pool.
